Terms and conditions
Part I — Terms of Use
1. Who we are and acceptance of the Terms
Keiken is a digital service for discovering, creating, collecting and sharing places (“Spots”), operated by Alan Ribeiro, established in Portugal (“Keiken”, “we”, “our”). These Terms govern access to and use of the application, website and related services.
By creating an account, accessing Keiken or publishing content, you agree to these Terms, the Privacy Policy and the Community Guidelines. If you do not agree, do not use the service.
If the law of your country grants mandatory consumer rights that cannot be waived by contract, those rights prevail over any incompatible provision of these Terms.
2. Minimum age and protection of minors
Keiken is intended for people aged 13 or older. Depending on the country of residence and the legal basis applicable to the processing of data, users below a higher age may need authorisation from a parent or legal guardian. By using Keiken, you represent that you meet the minimum age and the legal requirements applicable in your country.
Date of birth may be requested to determine the age range and to restrict categories that are unsuitable for minors. Categories marked as intended for adults, including bars, pubs, speakeasies and other categories defined by Keiken, may be hidden from users under 18 or without a recorded date of birth.
Date of birth is not displayed publicly.
3. Account and security
You are responsible for the information provided at registration and for the security of the means used to authenticate your account. You must not create accounts to impersonate others, use false identities for abusive purposes, sell accounts or allow unauthorised access.
We may offer authentication by email and by identity providers such as Apple and Google. Those providers’ terms may also apply to the respective authentication service.
You must keep your username and other profile information in line with the Community Guidelines.
4. What a Spot is
Spots are records of places made available on Keiken. A Spot may contain a name, category, place coordinates, photographs, descriptions, additional information and community contributions.
Much of the information about Spots is entered by users. Keiken does not guarantee that names, descriptions, opening hours, access details, coordinates, photographs, safety conditions, ownership, availability or other information are always complete, correct or up to date.
PHYSICAL SAFETY
The presence of a Spot on Keiken does not constitute permission to enter private property, restricted areas, closed, dangerous or specially regulated places. You are responsible for respecting signage, laws, local rules and instructions from the authorities or the people responsible for the place.
5. Location and presence verification
Certain features may require access to the device’s precise location. When you create or collect a Spot, Keiken may temporarily receive latitude and longitude in order to compare the device’s position with the Spot’s location and check whether the action can be completed.
The precise location used to verify a collect is not kept as the user’s location history after verification. The collect record may retain only the information needed to operate the service, such as the user identifier, the Spot, the date/time and the verification status.
The Spot’s own coordinates are stored because they are part of the place record and are required for discovery and proximity features.
6. User content
You may create or make available content, including Spots, photographs, descriptions, comments and other contributions (“User Content”). You keep the rights you hold in original content protected by copyright.
By publishing User Content, you grant Keiken a non-exclusive, worldwide, royalty-free licence, limited to what is necessary to host, store, reproduce, technically adapt, display and make that content available within the service, and to operate, protect and improve the related features. This licence ends when the content is removed, except to the extent a copy must remain temporarily in backups or factual non-personal information has been incorporated into a community record of the place.
You represent that you have the rights and authorisations needed to publish the content and that publication does not infringe third-party rights, including privacy, image, intellectual property or confidentiality.
7. Community records and account deletion
Deleting an account removes or disassociates personal data and content linked to the user, as described in the Privacy Policy. Factual information about a place — such as the Spot’s name, category and coordinates — may remain in the community database when it is no longer associated with the user’s identity and when keeping it is necessary to preserve the integrity of the service.
Photographs, comments and other content whose authorship remains identifiable will be removed or handled in accordance with the Privacy Policy and applicable law. Keiken will not use account deletion as a basis for turning personal content into anonymous content when re-identification remains reasonably possible.
8. Social features and blocking between users
Keiken may allow you to follow other users, be followed, comment, like, collect Spots and take part in gamification. These features must be used respectfully and without harassment, manipulation, spam or attempts to bypass blocks and restrictions.
Blocking a user is different from reporting them. When one user blocks another, Keiken limits visibility and interactions between the two accounts. The blocked user can no longer view the public profile and social content of the person who blocked them, and the relevant social relationships between them may be removed. Keiken may also hide those accounts from each other in search, feed, recommendations, followers, following and other social surfaces. A block is not a ban from the platform and can be reversed by the person who started it.
9. Prohibited content and behaviour
It is prohibited to use Keiken to:
publish illegal, fraudulent, misleading content or content intended to facilitate unlawful activity;
threaten, stalk, harass, intimidate or humiliate other people;
promote hatred or attacks against people or groups based on characteristics protected by applicable law;
publish exploitation or sexualisation of minors, solicit sexual content from minors or facilitate grooming;
publish pornography, explicit nudity or sexual content incompatible with the age rating and store policies;
disclose third parties’ personal data without a legitimate basis, including private addresses, documents, contact details or private location;
publish photographs or protected materials without the necessary rights;
create fake Spots, manipulate location, falsify collects, exploit flaws or manipulate XP, rankings or badges;
register as an attraction a private, restricted, dangerous or prohibited-access place in a way that encourages intrusion, trespassing or unsafe conduct;
engage in spam, scams, phishing, abusive advertising or unauthorised automation;
attempt to access accounts, systems, APIs or data without authorisation.
10. Reports, blocking, moderation and appeals
Keiken provides ways to report users and Spots and may extend reporting to comments, photographs and other content. Reports are handled confidentially as far as possible. The reporter may select a reason and, when available, provide additional context. The reporter’s identity is not disclosed to the reported user, except when required by law.
A report does not automatically amount to a violation. We may consider the content, context, severity, repeat behaviour, moderation history, the number of independent reports and other relevant evidence. The volume of reports may increase review priority or trigger preventive measures, such as placing a user or Spot under review or temporarily hiding a Spot, but it is not used on its own as the basis for a permanent ban.
Depending on the outcome of the review, we may close the report with no action, remove or correct content, issue a warning, restrict features, temporarily suspend an account or apply a permanent ban. In serious situations — including risk to minors, a credible threat, significant fraud, repeated abusive behaviour or physical danger — we may limit content, hide a Spot or suspend an account preventively while the situation is reviewed.
When a relevant moderation action is applied, the user may receive a general explanation of the reason, except when doing so could compromise an investigation, safety, third-party rights or a legal obligation. The user may submit an appeal when that option is available. The appeal is reviewed separately and may result in the measure being upheld, reduced or reversed; submitting an appeal does not guarantee reversal.
11. 18+ categories
Keiken may classify certain categories as “adults only”. Users under 18 or without a recorded date of birth may not see those Spots on the map, in search, feed, profiles, recommendations, Spot creation or direct access. The rules may vary by country and applicable law.
Age filtering does not guarantee that all displayed content is appropriate for every user. Report unsuitable content using the tools available in the app.
12. Keiken intellectual property
The application, design, brand, logos, software, interfaces, graphic elements, Keiken’s own texts and other materials created by Keiken are protected by applicable intellectual property laws. These Terms do not transfer to the user any ownership right in the service or the brand.
13. Third-party services
Keiken relies on third-party services for infrastructure, authentication, storage, notifications, maps, distribution and other features. Those services may be subject to their own terms and policies. We do not control third-party services and are not responsible for outages or changes outside our control, without prejudice to mandatory consumer rights.
14. Availability and changes to the service
We may fix, update, add, limit or remove features to improve safety, comply with laws, respond to abuse or evolve the product. We do not guarantee uninterrupted availability. When a material change affects users’ rights, we will provide appropriate notice when required by law.
15. Free use and future paid features
Keiken is currently free. We may introduce paid features, subscriptions or other models in the future. Any future charge will be presented in advance with the applicable prices, conditions and rules, and will not retroactively turn paid features into obligations that were not disclosed.
16. Limitation of liability
To the maximum extent permitted by applicable law, Keiken is provided “as is” and does not guarantee the accuracy of user-generated content, the physical safety of places, access to properties, the availability of establishments or the suitability of a Spot for a specific activity.
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including mandatory consumer rights or liability arising from conduct that the law prohibits limiting.
17. Suspension, closure and account deletion
We may restrict or suspend accounts when there is a violation of these Terms, the Community Guidelines, a safety risk or a legal obligation. Administrative suspensions are distinct from deletion requests made by the user.
The user may start account deletion in the app settings. After confirmation, the account enters a pending-deletion state for 15 days. During that period, the app may offer a way to restore the account. Restoration must require a conscious action by the user.
After the 15-day period, deletion is processed permanently in active systems, including removal of identifiable data, authentication credentials, notification tokens and other associated data that do not need to be retained for a legal obligation, safety or another legitimate basis provided by law.
18. Changes to these Terms
We may update these Terms. The current version will show the date of the last update. For material changes, we may provide notice in the app, by email or by another appropriate means. When the law requires fresh consent, we will request the corresponding action.
19. Governing law and dispute resolution
Without prejudice to the mandatory rules applicable to consumers in their country of residence, these Terms are governed by the laws of Portugal. Any clause on venue or governing law does not remove mandatory rights that local legislation grants to the user.

Part II — Privacy Policy
1. Data controller
The controller of the personal data described in this Policy is Alan Ribeiro, operator of Keiken, established in Portugal. For questions about privacy, data rights or this Policy, contact: zapcriativo@gmail.com.
2. Scope
This Policy explains which personal data Keiken processes when you use the application, website and related services, for what purposes they are used, with whom they may be shared, how long they are kept and which rights may be exercised.

4. Precise location
Keiken uses precise location only when it is needed for a requested feature. When collecting a Spot, the current location may be sent to the server for comparison with the Spot’s coordinates. After the verification decision, those user coordinates are not stored as location history and are not persisted in the collect record.
When creating a Spot, the place coordinates are stored as part of the Spot. If the user is physically at the place, this may indicate that they were there at the time of creation; for that reason, the link between the Spot and the creator is treated as data associated with the account for as long as that link exists.
You can control location permissions in the device settings. Denying permission may prevent features that depend on proximity or positioning.
5. Date of birth and age filtering
We store the full date of birth in order to calculate age correctly, determine eligibility and apply content restrictions. Date of birth is private, is not included in the public profile and must not be sent to other users.
If the date of birth is missing, Keiken may treat the account as not eligible for 18+ content until the information is provided. Categories marked as adults only may be filtered on the server and in the app.
6. Content entered by users
Information about places available on Keiken is largely provided by users. When contributing, you must not enter third parties’ personal data that are not necessary for a legitimate description of the place, nor publish private data, documents, contact details, private residential addresses or other information that could expose people to risk.
7. Purposes and legal bases
When the General Data Protection Regulation (GDPR) or similar rules apply, we process data on one or more legal bases, depending on the feature and the context:
Purpose
Typical legal basis in the EEA
Create and manage an account; provide Spots, collects, profile and social functions
performance of the contract / provision of the requested service
Minimum age and restriction of 18+ categories
performance of the service, legitimate interests in safety and protection of minors and, when required, legal compliance/consent
Precise location for a requested action
performance of the requested feature and, when required, valid consent/permission
Optional push notifications
consent/platform permission, when applicable
Moderation, anti-fraud, safety and abuse prevention
legitimate interests, performance of the Terms and/or compliance with a legal obligation
Respond to legal requests and protect rights
compliance with a legal obligation or legitimate interests in the exercise/defence of rights
Improve performance and diagnostics
legitimate interests and, when required, consent
The legal basis may vary by country. When processing depends on consent, you may withdraw it under applicable law, without affecting processing carried out before the withdrawal.
8. Minors
Keiken requires a minimum age of 13. In jurisdictions where the law requires parental authorisation or another condition for certain processing of minors’ data, we will apply the legally required requirements. In the European Economic Area, the age for independent consent to certain online services may vary between 13 and 16 when processing is based on consent.
Users under 18 do not receive categories classified by Keiken as intended for adults only. Keiken does not intend to use minors’ data for targeted behavioural advertising.
9. Who we share data with
We may share data only to the extent necessary with providers that help us operate Keiken. According to the architecture currently envisaged, those providers may include:
Provider / category
Use
Supabase
authentication, database and storage
Railway
API hosting and backend services
Vercel

Cloudflare
Turnstile bot protection when you request an invite. Cloudflare may process limited technical data (for example IP address and device or browser characteristics) to distinguish humans from automated traffic. This processing is described in the Cloudflare Turnstile Privacy Addendum, which we incorporate by reference into this Privacy Policy.
The effective list of providers must be kept up to date. We do not sell personal data to advertisers. If the business model later includes advertising or additional sharing, this Policy will be updated and any required consents will be requested.
10. International transfers
Some providers may process data outside the country where you live. When the GDPR or equivalent rules require safeguards for international transfers, we will use legally recognised mechanisms, such as adequacy decisions, standard contractual clauses or other applicable safeguards.
11. Retention
Data type
Retention rule
Account and profile
while the account is active and, after a deletion request, during the 15-day grace period
Date of birth
while needed to manage the account and age restrictions; removed when the account is purged
Precise collect location
processed for verification and not kept as history after the operation
Spots and factual place data
may remain while they are part of the community database, provided they are unlinked from the person when necessary
Likes, follows and social relationships
while needed for the account; removed or disassociated on deletion
Comments/photos linked to the user
while published; removed or disassociated on deletion according to law, policy and the nature of the content
Push tokens
while valid/needed; removed on deletion
Security logs
for the limited period needed for safety, abuse prevention, investigation and legal obligations
Backups
may contain residual copies for a limited technical period until overwritten; they are not used for normal operation after deletion
12. Account deletion
You may start account deletion in the Keiken settings and, when available, through a dedicated web page at https://keiken.life/delete-account. The request requires confirmation to reduce accidental deletions. Blocking between users and suspension or a ban for moderation are processes distinct from voluntary account deletion.
After the request, the account enters a pending-deletion state for 15 days. During that period, you may restore the account through the flow shown in the app. After the deadline, deletion is processed and should not be considered reversible.
On purge, we remove direct identifiers and personal profile data, including email/authentication identity, display name, bio, avatar, date of birth, push tokens and other data that directly identify the person. Personal social relationships, including follows and blocks linked to the account, are removed or disassociated when they are no longer needed. Moderation or security records may be kept in a limited way when needed to prevent abuse, handle appeals, protect users, comply with a legal obligation or defend rights.
To preserve the technical integrity of points history or internal references, an opaque technical identifier and the “deleted” status may remain when necessary. That identifier must not be used to reconstruct the person’s identity, contact them or maintain a behavioural profile after deletion. For as long as any reasonable link to the original identity remains possible, we treat that record as pseudonymised data and apply protection and limited retention.
Factual Spot records may remain as community content when they are no longer associated with the user’s identity. Personal or copyrighted content linked to the account will be deleted, disassociated or handled as required by applicable law and by the rules of the distribution platforms.
13. Security
We use reasonable technical and organisational measures to protect data, including access control, separation of public and private data, database access rules, credential management and limiting exposure of sensitive data. Blocking and moderation rules are also enforced on the server so that restricted content cannot be obtained merely by bypassing the application interface. No system is absolutely secure, but we work to reduce risks in proportion to the nature of the data.
Date of birth and other private data must not be included in public profile endpoints. Precise user coordinates used for verification must not be included unnecessarily in application logs or observability tools.
14. Your rights
Depending on applicable law, you may have rights of access, correction, erasure, restriction, objection, portability and withdrawal of consent. To exercise a right, contact zapcriativo@gmail.com. We may request reasonable information to confirm identity and protect the account.
In the European Economic Area, you may also lodge a complaint with the competent data protection authority. If the controller is established in Portugal, the Comissão Nacional de Proteção de Dados (CNPD) is one of the relevant authorities, without prejudice to the right to contact the competent authority in your place of residence or work when applicable.
15. Changes to this Policy
We may update this Policy to reflect legal, technical or product changes. The current version will show the update date. Material changes will be communicated appropriately and, when necessary, fresh consent will be requested.

Part III — Community Guidelines
Keiken exists to help people discover and share places. These Guidelines define the expected behaviour for keeping the community useful and safe. They apply to profiles, Spots, photographs, comments, usernames and other interactions.
1. Respect other people
Do not harass, threaten, stalk, intimidate or encourage attacks against other people.
Do not publish content intended to humiliate, sexualise or expose someone without consent.
Do not encourage discrimination, hatred or violence against people or groups protected by applicable law.
2. Publish real places and useful information
Create Spots that correspond to real places or legitimate experiences within Keiken’s purpose.
Choose coordinates, name and category in good faith and correct mistakes when you realise the information is wrong.
Do not create fake Spots, deliberate duplicates or misleading information to gain XP, badges or visibility.
3. Do not encourage intrusion or danger
Do not present private property as a place of free access without authorisation.
Do not encourage entry into closed areas, critical infrastructure, construction sites, tunnels, abandoned buildings or prohibited zones when that could put people at risk or break the law.
Respect signage, opening hours, owners’ rules and instructions from the authorities.
If a Spot becomes dangerous, inaccessible or prohibited, use the appropriate report.
4. Protect minors
Any content involving child sexual exploitation, grooming, sexual solicitation or sexualisation of minors is prohibited.
Do not publish information that unnecessarily reveals a minor’s private location, school, address, routine or contact details.
Categories classified as 18+ must not be used to bypass age restrictions or to direct minors to unsuitable environments.
HIGHEST PRIORITY
Content involving serious risk to minors may be removed immediately and the account may be suspended preventively. When required by law, information may be preserved and reported to the competent authorities.
5. Sexual and violent content
Do not publish pornography, explicit nudity or sexual content intended to arouse.
Do not publish gratuitous graphic violence, credible threats or encouragement of assaults.
Legitimate contextual content may be restricted or removed when it is incompatible with the experience, the age rating or store policies.
6. Privacy and personal data
Do not publish private residential addresses, documents, phone numbers, private emails or other third parties’ personal data without authorisation and a legitimate need.
Do not use comments, Spots or photographs to stalk or track a person.
Avoid photographs in which identifiable people are the main focus without appropriate consent, especially minors.
7. Copyright and image rights
Publish photographs and texts that you created or have the right to use.
Do not copy content from websites, social networks, photographers or other users without authorisation.
Respect image rights, trademarks and other forms of intellectual property.
8. No spam, fraud or manipulation
Do not send spam, phishing, scams, malicious links or repetitive unauthorised advertising.
Do not use automation, multiple accounts or falsified location to manipulate collects, rankings, XP, badges, likes or followers.
Do not exploit vulnerabilities or try to bypass limits, bans or protection mechanisms.
9. Report, block and protect your experience
If you find content or behaviour that violates these Guidelines, use the “Report” function for the relevant user or Spot and, when available, for comments, photographs or other content. To stop personal interactions, use “Block”.
When you block another user, that person can no longer view your public profile and social content on the surfaces where the block applies and can no longer interact socially with you. Keiken may also hide the two accounts from each other and remove existing follow relationships. Unblocking does not automatically restore previous relationships. False reports, coordination to harass another person or abusive use of the reporting system may also result in moderation measures.
10. Common report reasons
User/content
Spot/place
Harassment or bullying
Incorrect location
Spam or fraud
Place does not exist
Fake profile / impersonation
Private property
Sexual content
Entry prohibited
Hate, threat or violence
Dangerous place
Child safety
Duplicate or spam
Privacy violation
False/outdated information
Copyright
Other relevant reason
11. How we moderate
A report does not automatically amount to guilt. We may consider the severity of the content, available evidence, context, repeat behaviour and the history of previous actions. A larger volume of independent reports may increase review priority. When internal safety limits are reached, a Spot may be temporarily hidden or placed under review and an account may receive priority review or preventive restrictions. Those limits are protection mechanisms and do not, on their own, constitute proof of a violation or an automatic basis for a permanent ban.
Possible measures include:
no violation / closure of the report;
removal or correction of content;
warning;
temporary restriction of features;
temporary suspension;
permanent ban.
12. Appealing decisions
When a relevant moderation action is communicated, Keiken may allow an appeal. The appeal should explain why the decision would be incorrect and may be limited to one per moderation action, except in exceptional circumstances.
The review may uphold, reduce, remove or, when technically possible, reverse the measure. The identity of the person who made the report is not disclosed to the reported user, except where there is a legal obligation.
13. Serious consequences and authorities
When there is an immediate risk to safety, exploitation of minors, a credible threat, serious fraud, illegal activity or a legal obligation, we may preserve necessary information, suspend access, remove content and cooperate with the competent authorities in accordance with the law.
14. Contact
Questions about these Guidelines, reports, blocks or moderation decisions may be sent to zapcriativo@gmail.com.
